TERMS AND CONDITIONS FOR MONTHLY SUBSCRIPTION TO ACTIVE LEARNERS CLASSES

Introduction

These terms and conditions ("Terms") govern your use of our monthly subscription service ("Service") for active learner classes. By subscribing to the Service, you agree to be bound by these Terms.

Subscription

2.1. Subscription Period: The subscription period begins on the date that you sign up for the Service and continues on a monthly basis until you cancel.

​

2.2. Payment: You will be charged the monthly subscription fee in advance of each subscription period. We reserve the right to change the subscription fee at any time, but we will notify you of any changes before they take effect.

2.3. Automatic Renewal: Your subscription will automatically renew each month unless you cancel before the end of the current subscription period. 

​

2.4. Cancellation: You may cancel your subscription at any time by notifying us 48 hours before the next class. If you cancel during a subscription period, you will not receive a refund for that period.

​

Classes

3.1. Class Schedule: We will provide a schedule of classes to you in advance, and we reserve the right to change the schedule at any time.

​

3.2. Attendance: You are responsible for ensuring that your child attends each class. We are not responsible for missed classes.

​

3.3. Liability: You acknowledge that participating in toddler fitness classes carries inherent risks, and you assume all risks and responsibilities associated with your child's participation in the classes. We are not responsible for any injuries or damages that may occur during the classes.

Intellectual Property

4.1. Ownership: All content provided as part of the Service, including but not limited to videos, images, and text, is our property or the property of our licensors, and is protected by copyright and other intellectual property laws.

4.2. License: We grant you a limited, non-exclusive, non-transferable license to access and use the content for personal, non-commercial purposes only.

Privacy

5.1. Collection and Use of Information: We may collect and use personal information about you and your child in accordance with our Privacy Policy, which is incorporated by reference into these Terms.

​

5.2. Disclosure: We may disclose personal information about you and your child to our affiliates, service providers, and as required by law.

​

5.3. Photos: To comply with our ‘Safeguarding & Child Protection Policy’ and best practice, we request that parents/carers DO NOT take photographs or videos at class. Whilst our coaches will do their best to enforce a total ban on the use of photographic/film or video equipment by parents/carers at classes, due to the nature of their work and the concentration required during the delivery of sessions, we are unable to guarantee this, and your cooperation would be appreciated.

Miscellaneous

6.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Republic of Ireland.

​

6.2. Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service, and supersede all prior or contemporaneous communications and proposals, whether oral or written.

6.3. Modification: We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a notice on our website
